This section defines the terminology used throughout this documentation to avoid ambiguity.
- User / you: an individual or entity using our Services.
- Service / Services: all offerings of ServerF.Hosting (servers, APIs, dashboards, etc.).
- Content: data, files, configuration, software, or media stored or processed via the Service.
- Third-Party Services / Processors: external providers supporting parts of our platform (e.g. PayPal, Firebase).
- Terms / Agreement: this Terms of Service plus Privacy & Data Policy and any referenced policies.
2. Terms of Service
2.3 Service Usage, Fees & Billing
You must keep an active monthly subscription to maintain access to the Service.
- Plans & Pricing (Euros): Starter: €4,99/month · Pro: €18,99/month · Business: €39,99/month
- Payment Terms: Invoices issued monthly, due within 30 days, payable via PayPal only.
- Taxes & Duties: Fees are exclusive of applicable taxes. You are responsible for any tax obligations.
- Non-Refundability: All payments are final and non-refundable. We do not issue prorated credits or refunds.
2.4 User Obligations & Conduct
- Use the Service in compliance with law and these Terms.
- Secure your account credentials and notify us immediately of unauthorized access.
- Ensure all hosted content is lawful and properly licensed.
- Refrain from fraudulent, harassing, or malicious behavior.
2.5 Content, Intellectual Property & Hosting Restrictions
- Prohibited to host or transmit any illegal content (e.g. child exploitation, human trafficking, hate speech).
- Cannot host copyrighted content without proper license or permission.
- Virtual machines or containers must comply with the same rules, even on free tiers.
- We reserve the right to remove or disable access to content following valid takedown notices.
2.8 Termination, Suspension & Data Deletion
We may suspend or terminate your account immediately for breach of these Terms.
Non-Payment: If your payment is more than 30 days overdue, your server and all associated content will be permanently deleted and unrecoverable.
Following termination, we have no obligation to preserve your data. Provisions concerning liabilities, indemnification, etc., survive termination.
Other Key Clauses
- Disclaimer & Warranties: Services are provided “as is” without warranty. No SLA or uptime guarantee is offered.
- Limitation of Liability: No liability for indirect or consequential damages; direct liability capped.
- Indemnification: You will defend and hold us harmless from claims arising from your use or content.
- Governing Law & Disputes: German law governs; disputes resolved in German courts.
- Changes to Terms: We may update the Terms; posting them constitutes notice. Continued use means acceptance. See Terms of Service Page.
3. Privacy & Data Policy

We collect minimal data, strictly for core functions, billing, and system integrity. Below is a brief summary:

4.1 Why These Clauses Matter
Clear terms reduce misunderstandings, set expectations, and protect both you and us. Privacy compliance (especially under GDPR) builds trust and legal legitimacy.
4.2 GDPR, Controllers & Processors in Hosting
In many hosting setups, the host acts as a data processor and the site owner as the controller. However, for our operations (accounting, user authentication, billing), we also act as a controller for the data we collect. We still provide protections and transparency as required by law.
4.3 Intermediary Liability in the EU
Under the EU e-Commerce Directive, hosting providers may benefit from “safe harbor” protections if they promptly remove content upon notice and do not have actual knowledge of illegal content. Nevertheless, we reserve the right to act proactively if we detect violations of our policies.

- A clear description of the request (e.g. “delete my data,” “export my account”)

We aim to respond promptly, in compliance with applicable laws and our policy obligations.
