ServerF.Hosting Terms of Service

Welcome to ServerF.Hosting. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you") and ServerF.Hosting ("we," "us," or "our") and govern your use of all services provided by us. By accessing or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

1. Fees, Billing, and Refunds

Use of our paid services requires mandatory monthly payment to maintain service availability and cover resource allocation fees.

Pricing Structure: Current plan prices are fixed globally and specified in Euros (€): Starter (€4,99), Pro (€18,99), and Business (€39,99).
Payment Due Date: Payment is due within thirty (30) days of the invoice date.
Payment Method: All payments must be processed exclusively through PayPal. Your use of this payment method is subject to PayPal's terms and conditions.
Taxes and Duties: All fees are exclusive of any local, state, federal, or international taxes, duties, or assessments, and you are solely responsible for payment of all such taxes.
Non-Refundable Fees: All fees are non-refundable. Due to the immediate allocation of dedicated resources and the necessary destruction of server infrastructure upon termination, we do not offer refunds, prorated or otherwise, for any reason, including early termination by the User.

2. Data Collection and Use

By using our services, you grant us consent to collect and utilize certain data for the purpose of limited analytics. This data is collected to analyze service usage, monitor performance, and enhance the user experience. The collected information may include non-personally identifiable data such as usage patterns, technical performance metrics, and general service interaction data.

3. User Responsibilities

You are solely responsible for your conduct and content while using our services. You hereby agree to:

Utilize the service exclusively for its intended purpose and refrain from engaging in any malicious, disruptive, or unauthorized activities.
Ensure the security and confidentiality of your account credentials and bear full responsibility for all activities that occur under your account.
Immediately notify us of any unauthorized use of your account or any other breach of security.

4. Prohibited Content and Use & Resource Limits

We maintain a strict prohibition against the illegal, illicit, unauthorized, and commercial use of our services. The service is intended strictly for personal, development, and non-profit educational use only. Prohibited uses include, but are not limited to:

Commercial Use Prohibition: The service may not be used for any commercial purpose, including, but not limited to, running a business, selling services, generating revenue, or supporting third-party commercial applications.
Cryptocurrency Mining and Abuse: Any activity related to the creation, generation, farming, or mining of cryptocurrency, blockchain assets, or virtual tokens (including, but not limited to, Bitcoin, Ethereum, and Chia) is strictly prohibited. This includes running proof-of-work or proof-of-stake validators and any activity designed to maintain 100% continuous resource utilization.
Unlawful and Illicit Content: You are expressly prohibited from storing, transmitting, or hosting any content that is unlawful, including, but not limited to, child pornography or content related to human trafficking.
Infringement of Intellectual Property: You may not use our service to host or distribute copyrighted content, images, software, or any other intellectual property for which you do not possess the necessary rights or licenses.
Virtual Machines: This prohibition extends to any and all content and activities associated with virtual machines hosted on our "Free Tier." You are obligated to ensure all content and activities on your virtual machines comply fully with these Terms.
Resource Abuse: You agree not to abuse the server resources provided. Excessive consumption of CPU cycles, memory, disk I/O, or bandwidth that negatively impacts the performance or stability of other services or the overall platform may result in immediate suspension or termination, at our sole discretion.

Any violation of this section will result in the immediate and permanent termination of your service, at our sole discretion, and may result in the reporting of such activities to the appropriate law enforcement authorities.

5. Third-Party Integrations and Links

Our services may integrate with, or contain links to, third-party websites or services, including, but not limited to, Discord, Firebase, or Supabase. You acknowledge and agree that your use of such third-party services is governed by their respective terms and conditions and privacy policies. We do not endorse and are not responsible for the content, products, or services offered by these third parties. Your access and use of these external services are solely at your own risk. ServerF.Hosting shall have no liability or responsibility for your use of any third-party services.

6. Termination and Data Deletion

We reserve the right to suspend or terminate your access to the service immediately, without prior notice or liability, for any reason whatsoever, including, without limitation, if you breach these Terms.

Termination for Non-Payment: If payment for your monthly service fee is not received within thirty (30) days of the invoice due date, your server will be automatically and permanently deleted. All data, content, and configurations associated with the unpaid server will be irreversibly destroyed and unrecoverable. You acknowledge and accept this risk of data loss associated with non-payment.

7. Disclaimer of Warranties

The service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we make no warranties, either express or implied, regarding the service's reliability, availability, or fitness for a particular purpose. No Service Level Agreement (SLA) or uptime guarantee is provided.

8. Limitation of Liability

In no event shall ServerF.Hosting, its directors, employees, or affiliates, be liable for any indirect, incidental, special, or consequential damages arising from your use of the service, including but not limited to lost data or lost profits, whether based on warranty, contract, tort (including negligence), or any other legal theory.

9. Indemnification

You agree to indemnify, defend, and hold harmless ServerF.Hosting, its affiliates, directors, officers, and employees from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) that arise from or relate to your breach of these Terms, your use of the Service, or any content you host or transmit via the Service.

10. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Germany, without regard to its conflict of law provisions. You and ServerF.Hosting agree to submit to the exclusive jurisdiction of the courts located within Germany to resolve any legal matter arising from these Terms.

11. Changes to the Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any changes by posting the new Terms on this page. Your continued use of the service after any such changes constitutes your acceptance of the new Terms.
